1. Seller
The Seller is WebImmagine di De Prisco Maria Daniela, registered at Via Dario Scaglione 4, Alba (CN), Italy, VAT number IT03841410040, customer-support email: support@activitybookshop.com (the “Seller”).
2. Scope and customer
These Terms govern distance purchases of digital products made through activitybookshop.com. By placing an order, the customer confirms that they are at least 18 years old or otherwise have the legal capacity required to enter into the contract.
A “Consumer” is an individual purchasing for purposes outside their trade, business, craft or profession. Any mandatory consumer rights under applicable law remain unaffected.
3. Digital product
Unless otherwise stated on the product page, the purchase of First Italian Words for Kids includes:
- the digital activity book in PDF format, supplied in both A4 and US Letter versions;
- access to the Audio Library linked to the book, containing the pronunciations and other audio content described on the product page; and
- the personal, household or single-classroom licence described in section 10.
This is a digital product. No printed book or other physical item will be shipped. Images, previews and descriptions on the website illustrate the content. Minor differences caused by the customer’s device, software, screen or printer do not constitute a defect in the product.
4. Technical requirements
To use the product, the customer needs a compatible device, an internet connection, software capable of opening PDF files and, for audio playback, an up-to-date browser and an audio-capable device. A printer compatible with the selected paper size is required to print the book. Internet, printing, paper and consumable costs are the customer’s responsibility.
Print results may vary depending on the printer, settings, paper and supported margins. A test page should be printed before printing the full book. This does not limit the customer’s rights where the file itself is defective or non-conforming.
5. Ordering and contract formation
Before paying, the customer can review the product characteristics, total price, information entered and these Terms. Placing the order creates an obligation to pay.
The contract is formed when payment is authorised and the customer receives an order confirmation at the email address provided. The Seller may refuse or cancel an order where payment is unauthorised, there is an obvious pricing error, fraud or unlawful use is suspected, or it is technically impossible to supply the product. Any amount collected will be refunded without undue delay.
The order confirmation must include or attach the version of the Terms accepted by the customer and confirmation of the customer’s express consent to immediate supply and acknowledgement of the resulting loss of the right of withdrawal.
6. Price and payment
Prices may be displayed and charged in euros, US dollars or another currency made available at checkout. The total price and currency payable are those displayed at checkout before the order is placed and include any taxes applied by the Seller where required and shown. Payment is processed through the payment service provider available at checkout.
If the customer’s account or card is denominated in a currency different from the currency selected at checkout, their bank or payment provider may apply currency conversion, fees or mark-ups over which the Seller has no control.
7. Supply, download link and access limits
After payment is confirmed, the product is made available through the download page and/or a link sent to the email address supplied by the customer. The download link remains valid for 30 days and permits a maximum of 5 downloads.
The customer must provide a correct email address, check their spam folder and retain a copy of the downloaded file. Expiry of the link or use of all permitted downloads does not terminate the licence already purchased. If a problem occurs, the customer may contact support. The Seller may verify the purchase and, where reasonably possible, restore access.
The link and access tools are personal and may not be transferred, published or shared outside the scope permitted by the licence.
8. Audio Library
Access to the Audio Library is an integral part of the purchased product and is provided without a predetermined expiry date. Access is intended for the customer and the people covered by the licence: members of the same household or students in the authorised single classroom.
The Seller may update, replace or migrate the technology, web address, interface or authentication method used for the Audio Library, provided that legitimate purchasers retain a reasonable way to access the purchased content. Temporary interruptions may occur for maintenance, security or circumstances beyond the Seller’s reasonable control.
Access without a predetermined expiry date does not mean that the same URL, design or technology is guaranteed to remain unchanged indefinitely. This section does not limit any mandatory remedies available where the content is not supplied or is non-conforming.
9. Right of withdrawal for digital content
A Consumer normally has 14 days to withdraw from a distance contract. However, to receive the download and access immediately, before purchasing the Consumer must:
- give express consent for the immediate supply of the digital content to begin before the end of the withdrawal period; and
- acknowledge that, once the download or access to the digital content begins, the Consumer loses the right of withdrawal.
Accordingly, once immediate supply has begun with the Consumer’s consent and acknowledgement, no refund is available for a simple change of mind. If supply has not yet begun, the rights provided by applicable law continue to apply.
The loss of the right of withdrawal does not affect rights relating to failure to supply, defective files, lack of conformity or any other breach by the Seller.
10. Licence
The purchase does not transfer ownership of any intellectual-property rights. The Seller grants the customer a personal, limited, non-exclusive and non-transferable licence, which may be revoked for a material breach of these Terms.
The licence permits either:
- personal and household use, including printing multiple copies for members of the same household; or
- use by one teacher in one classroom directly taught by the purchaser, including printing copies for the students in that classroom.
The customer must not:
- share, forward, lend, transfer or sell the PDF file, download link or access credentials;
- upload the PDF or audio files to websites, social networks, file-sharing services, public repositories, shared drives or systems accessible to unauthorised people;
- use one purchase for multiple households, teachers, classrooms, an entire school, association or organisation;
- modify, extract, reproduce or reuse images, text, audio or pages to create derivative products for sale, distribution or commercial purposes; or
- remove copyright notices, trademarks or other proprietary notices.
Use in multiple classrooms, across an entire school or in another collective setting requires a separate licence agreed with the Seller.
11. Conformity and support
The Seller is responsible for supplying the digital content and for its conformity as required by applicable law. If a file is missing, corrupted, incomplete, different from its description or inaccessible for reasons attributable to the Seller, the customer should contact support, describe the issue and provide the email address used for the purchase.
The Seller may supply the file again, restore access, correct the defect or provide any other remedy required by law. Nothing in these Terms excludes or limits any mandatory guarantee or remedy available to a Consumer.
12. Educational use and responsibility
The product is an educational activity resource. It does not replace a school curriculum, professional advice or a pedagogical assessment. The Seller does not guarantee a particular learning outcome, which also depends on the child’s age, use of the materials and learning context.
Children should use the product under adult supervision. The customer is responsible for selecting suitable printing materials and for safe use of scissors, glue or any other tools used in the activities.
13. Intellectual property
The product, illustrations, text, design, audio, trademarks and other content are protected by copyright and intellectual-property laws. All rights not expressly granted under the licence are reserved by their respective owners.
14. Communications, support and complaints
Order-related communications are sent to the email address supplied by the customer. Support requests and complaints may be sent to support@activitybookshop.com. The customer should include the order number, where available, and the email address used for payment.
15. Personal data
Personal data is processed in accordance with the Privacy Notice published on the website. Data required to complete the purchase and supply the product is processed to perform the contract and comply with legal obligations. Newsletter subscription is optional, separate from the purchase and based on specific consent that may be withdrawn.
16. Governing law and disputes
These Terms and the contract are governed by Italian law. This choice does not deprive a Consumer of any mandatory protection granted by the law of the country in which the Consumer habitually resides, where applicable.
Disputes involving a Consumer are subject to the courts determined by applicable mandatory law, including, where required, the courts of the Consumer’s place of residence or domicile. For customers who are not Consumers, the courts of Asti, Italy, have exclusive jurisdiction unless mandatory law provides otherwise.
17. Amendments, validity and retention
The version of these Terms accepted when the order is placed applies to that contract. Later amendments apply only to future purchases unless required by law or more favourable to the customer.
If any provision is found invalid or unenforceable, the remaining provisions continue in effect. The customer should retain the order confirmation and the copy of these Terms supplied on a durable medium.
